1. Services
ByMeliPadi LLC provides brand identity design and web design services. The specific scope, deliverables, timeline, and pricing for each project will be outlined in a separate project proposal and/or contract agreed upon by both parties prior to the start of any work.
2. Inquiries and Project Proposals
Submitting a contact form on our website does not constitute a binding agreement. A project only begins once both parties have signed a contract and a deposit has been received.
3. Payment
Payment terms, deposit amounts, and payment schedules will be specified in your individual project contract. We reserve the right to pause or terminate work if payments are not received according to the agreed schedule.
4. Revisions
The number of revisions included in your project will be outlined in your contract. Requests for revisions beyond the agreed scope may be subject to additional fees.
5. Intellectual Property
Upon receipt of full payment, the client will own the final approved brand assets. ByMeliPadi LLC retains the right to display completed work in our portfolio, on our website, and on social media for promotional purposes unless otherwise agreed in writing.
All preliminary concepts, drafts, and creative directions that are not selected remain the intellectual property of ByMeliPadi LLC.
6. Client Responsibilities
The client is responsible for providing accurate and complete information needed to complete the project. Delays caused by late feedback or missing materials from the client may affect the project timeline and are not the responsibility of ByMeliPadi LLC.
7. Cancellations and Refunds
Deposits are non-refundable. If a project is cancelled after work has begun, the client is responsible for payment for all work completed up to the point of cancellation. Specific cancellation terms will be outlined in your project contract.
8. Limitation of Liability
ByMeliPadi LLC is not liable for any indirect, incidental, or consequential damages arising from the use of our services or website. Our total liability shall not exceed the amount paid by the client for the specific project in question.
9. Website Use
You agree to use our website for lawful purposes only. You may not use our website in any way that causes damage to the website or impairs the availability or accessibility of the website.
10. Changes to These Terms
We reserve the right to update these Terms & Conditions at any time. Changes will be posted on this page with an updated date. Continued use of our website after changes are posted constitutes your acceptance of the revised terms.
11. Governing Law
These Terms & Conditions are governed by the laws of the State of Florida. Any disputes arising from these terms or our services shall be resolved in the courts of Florida.
